Terms of Service

1. Acceptance of Terms

By accessing and using the Finivex payment gateway platform, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you must not use the service.

2. Use License

Permission is granted to use Finivex to accept, process, and manage payments for lawful personal and commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy proprietary materials, APIs, or software belonging to Finivex
  • Use the service for any illegal purpose or in any illegal manner
  • Attempt to decompile, disassemble, or reverse engineer any part of the platform
  • Remove any copyright, trademark, or other proprietary notations
  • Resell, sublicense, or redistribute access to the Finivex APIs without written consent

3. Prohibited Content and Activities

Merchants and users must not process payments for, engage in, or promote:

  • Illegal goods, services, or activities under the laws of Zimbabwe or the jurisdiction of the payer
  • Intellectual property infringement or counterfeit goods
  • Hate speech, harassment, or discrimination
  • Fraudulent, deceptive, or misleading practices, including unauthorized card testing
  • Distribution of malware, spyware, or other harmful software
  • Violation of privacy rights or unauthorized data collection
  • Money laundering, terrorism financing, or sanctions evasion

4. Merchant Accounts

Merchants and users are responsible for:

  • Maintaining the confidentiality of account credentials and API keys
  • All transactions and activities that occur under their account
  • Providing accurate, current, and complete business and KYC information
  • Notifying Finivex immediately of any unauthorized use or security incident

5. Fees and Settlement

Transaction and service fees are charged as set out in your merchant agreement or published pricing. Fees may be deducted at settlement or billed separately. Settlement to your nominated bank account is subject to successful clearing with the underlying payment networks and applicable compliance checks. Except where required by law, fees already collected on completed transactions are non-refundable.

6. Disclaimer

The Finivex platform is provided on an "as is" and "as available" basis. Finivex makes no warranties, expressed or implied, and hereby disclaims all other warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

In no event shall Finivex or its suppliers be liable for any damages (including, without limitation, damages for loss of data, profit, or business interruption) arising out of the use of or inability to use the platform, even if Finivex has been notified of the possibility of such damages.

8. Age Restrictions

Finivex is intended for users who are at least 18 years old and legally able to enter into binding contracts. The service is not directed at children.

9. Governing Law

These terms are governed by and construed in accordance with the laws of Zimbabwe. You irrevocably submit to the exclusive jurisdiction of the courts of Zimbabwe for the resolution of any dispute arising out of or in connection with these terms.
